The service and its limits

Trusts & Wills and Everstead provide self-help template generation, educational information, and organizational tools only. We are not a law firm and do not provide legal advice, representation, or attorney-client privilege. Generated materials may contain errors or omissions and are not approved legal instruments.

The website provides educational guides, planning worksheets, organizational tools, and a limited Nevada template-generation workflow. Outputs are unexecuted review materials, not a completed estate plan. We do not act as your attorney, fiduciary, trustee, executor, tax adviser, financial adviser, or notary. No professional engagement is created by using the tools or contacting support. No attorney has approved the current templates.

Independent attorney review before any use

Always have an independent attorney licensed in the relevant jurisdiction review and finalize every legal document before you sign, notarize, file, transfer property, or otherwise rely on it. This release produces review drafts only: do not sign them. A notary does not replace legal review, and notarization alone does not establish validity or fund a trust.

You are responsible for obtaining advice appropriate to the people, assets, jurisdictions, and objectives involved. Review is particularly important for existing trusts, married or joint settlors, minors, vulnerable beneficiaries, public benefits, creditor issues, business interests, foreign connections, tax planning, and potential family disputes. A questionnaire result does not establish legal suitability, capacity, authority, or compliance.

Your information, choices, and actions

You are responsible for the accuracy and completeness of your entries, your legal authority to provide them, and your decisions about whether and how to use an output. Verify names, beneficiaries, percentages, ownership, deadlines, applicable law, and consistency with existing instruments with your attorney. Do not use the service to coerce, impersonate, defraud, unlawfully disclose another person’s information, or exercise authority you do not hold.

A generated document does not sign itself, revoke an existing instrument, appoint a fiduciary, transfer title, change an account beneficiary, satisfy court requirements, or fund a trust. Signing, witnessing, acknowledgment, filing, recordkeeping, and asset transfers require separate attention. You are responsible for arranging those steps with appropriate professionals and institutions.

No warranties or promised outcomes

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE, INFORMATION, TEMPLATES, AND OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant accuracy, completeness, currency, legal validity, suitability, uninterrupted availability, error-free operation, or acceptance by any attorney, notary, court, government agency, beneficiary, bank, or other institution.

We do not guarantee avoidance of probate, tax savings, creditor protection, benefits eligibility, preservation of an inheritance, prevention of disputes, or any legal, financial, or family outcome. Laws and circumstances change. A source link or publication date is not a promise to monitor changes or update an output already downloaded.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Pacifica Games LLC and its officers, employees, contractors, and service providers will not be liable for damages, losses, costs, or claims arising out of access to, inability to access, use of, or reliance on the service or its outputs. This limitation includes direct, indirect, incidental, consequential, special, exemplary, and punitive losses where their exclusion is lawful, whether a claim is framed in contract, tort (including ordinary negligence where lawfully excludable), or another legal theory.

Examples include an ineffective or disputed instrument, unintended distributions, lost inheritance, taxes or penalties, public-benefit consequences, creditor claims, probate or litigation expenses, professional fees, missed deadlines, incomplete funding, unauthorized use of an output, and lost or disclosed data. These examples describe the intended allocation of risk; they do not expand any exclusion beyond what applicable law permits.

Nothing in these terms excludes or limits liability for fraud, willful misconduct, gross negligence, or any other liability that applicable law does not allow to be excluded or limited. Mandatory consumer protections, statutory remedies, and other nonwaivable rights remain intact. If an exclusion cannot lawfully apply to a particular claim or person, that exclusion does not apply to that extent.

Family, beneficiaries, estates, and professional advisers

The service is not retained to protect the separate interests of your spouse, relatives, heirs, beneficiaries, estate, trustees, executors, attorneys, or other advisers. No third-party beneficiary rights are intended to be created by these terms, except to the extent required by law. Anyone reviewing an output must perform their own appropriate verification; an adviser’s participation is not our endorsement or supervision.

You cannot waive another person’s independent rights merely by using this website. These terms do not claim that a family member, beneficiary, estate, or attorney has agreed to release a claim solely because you used the service. Limits may apply to persons asserting claims through you only to the extent applicable law permits. Preserve the notices when sharing an output and tell recipients it requires independent legal review.

Third-party claims caused by misuse

To the extent permitted by law and where these terms form an enforceable agreement, you agree to indemnify Pacifica Games LLC for third-party claims, reasonable losses, and reasonable legal costs to the extent caused by your unlawful use of the service, infringement of another person’s rights, or knowing material misrepresentation of your authority or information. This provision does not require you to indemnify us for our own negligence, fraud, gross negligence, willful misconduct, or other liability that cannot lawfully be shifted. It does not penalize a good-faith complaint, honest review, or exercise of a protected right.

Storage, downloads, and outside services

Planning and Nevada answers remain in browser memory unless you opt into device saving. Saved copies and downloads are not encrypted by the application. The ledger has separate device-storage behavior. Keep appropriate backups, restrict access to your device, and share files thoughtfully. Clearing browser data may permanently remove local records. External professionals, websites, hosting providers, financial institutions, and government agencies operate independently. We do not control their advice, decisions, availability, or services. An external link is not a promise of accuracy or a professional referral engagement.

Free preview, ownership, and future services

The current planning and Nevada workflows are free. Displayed future prices do not create a purchase, subscription, professional engagement, or right to a future service. Paid services, if introduced, will require separate scope, pricing, cancellation/refund disclosures, and applicable consent before charging.

You retain rights in the original information you supply. You may download, retain, and share generated review materials with your chosen advisers for your planning purposes. Keep the draft and safety notices with them. We do not grant rights to another party’s proprietary legal forms, trademarks, or protected content.

Applicable rights and changes

These terms are intended to apply only as far as applicable law and valid agreement allow. Merely posting a notice does not establish that every visitor or recipient has entered an enforceable contract. No arbitration requirement, class-action waiver, waiver of jury trial, or exclusive court venue is imposed by this release. Nothing prevents an honest review, complaint to a regulator, or exercise of a protected legal remedy.

If a provision is unenforceable, the remaining provisions apply only to the extent they can lawfully stand independently. Updates will carry a new version or date and will not be represented as retroactively waiving rights. These terms themselves have not been approved by the user’s attorney and do not guarantee immunity from a claim.
